HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRLP.No.665 of 2014 ORDER :

This Criminal Petition is filed by the Petitioner/Accused No.2 under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.307 of 2013 of Zaheerabad Town Police Station, Medak District registered for the offence punishable under Section 420 I.P.C alleging that it is a dispute of civil nature.

2) When the matter came up for hearing, the learned Public Prosecutor submitted that in the above crime, the police concerned already filed charge sheet after completion of the investigation under Section 173 Cr.P.C and no cause survives for adjudication in this criminal petition and the same has become infructuous.

3) Recording the said submission, this criminal petition is dismissed as infructuous without prejudice the rights of the petitioner/ accused No.2 to impugn if at all the cognizance taken by the learned Magistrate on the charge sheet from the material covered by the charge sheet either under Section 239 Cr.P.C before the trial Court or otherwise.
