THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.20279 of 2016 ORDER:

The petitioner is working as Conductor in Kurnool-1 Depot. While he was working as such, a charge memo dated 07.04.2015 was issued framing charges against him. The petitioner submitted his explanation on 29.04.2015. Thereafter, an enquiry officer was appointed by proceedings dated 02.05.2015 and he conducted a preliminary enquiry. On the basis of the preliminary enquiry report, the petitioner was directed to appear before the enquiry officer on 04.07.2015. After appearance, a report was submitted on 01.08.2015 to the Regional Manager, Kurnool. Based on the said report and after calling for objection from the petitioner on 19.08.2015, a show cause notice for removal from service was issued on 24.08.2015. The petitioner submitted his explanation on 31.08.2015. The Depot Manager issued proceedings on 08.09.

2015 removing the petitioner from service with immediate effect. Challenging the said order, the petitioner preferred an appeal to the Chief Traffic Manager, Kurnool, and the same was dismissed by proceedings dated 05.10.2015. Against the said order, the petitioner preferred a review petition before the Regional Officer, Kurnool, who also dismissed the same by proceedings dated 31.03.2016. Now the present Writ Petition is filed challenging the proceedings dated 08.09.2015 passed by the Depot Manager, Kurnool, removing the petitioner from service.

When this Court advised the learned Counsel for the petitioner to move the Labour Court, learned Counsel for the petitioner submitted that if a direction is granted to the respondents to pay the benefits which are due to the petitioner consequent to the removal from service, it would be sufficient for the petitioner.

In the circumstances, this Writ Petition is disposed of directing

the respondents to pay the amounts due to the petitioner, if any, according to law, consequent to the order of removal dated 08.09.2015, confirmed in appeal by order dated 05.10.2015 and review dated 31.03.2016, within a period of thirty days from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
