Keram Rama Seetha v. The State Of Andhra Pradesh

This writ petition is filed under Article 226 of the Constitution of India for the following relief:
"to issue order direction more particularly one in the nature of writ of MANDAMUS to declare the action of the respondents in not taking action on the complaint given by the petitioner on 26.07.2015 as illegal arbitrary and contrary to the provisions of Cr.P.C. and consequentially direct the respondents police to register the complaint filed by the petitioner 26.07.2015 against the persons who tresspass into my land covered in RS No.1516/1C Ac.0.37 Cts, RS No.1528/1C Ac.2.47 Cts, RS No.1547/2C Ac.1.30 Cts, RS No.1540/4P Ac.3.23 Cts, RS No.1501/P Ac.3.09Cts, RS No.1518/1BT Ac.0.34 Cts, RS No.1518/1BP Ac.1.84 Cts, RS No.1530/1 Ac.1.68 Cts, RS No.1517/1 Ac.0.18 Cts, RS No.1548/3B Ac.1.26 Cts, RS No.1540/1P Ac.0.5 Cts, total an extent of Ac.16.33 Cts situated at Buttaigudem V & M, West Godavari District. and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case."

When the matter is called today, written instructions dated 11.09.2015, furnished by the Station House Officer, Buttaigudem P.S., West Godavari District, have been placed on record by the learned Government Pleader for Home and the said instructions read as under: "It is respectfully submitted that one Keram Rama Seetha/the petitioner herein lodged complaint with the Sub Inspector of Police Buttaigudem stating that she is having a land an extent of Ac. 16.33 Cts in the village. After death of her husband the persons named Keram Venkateswara Rao, and his wife Keram Kannamma were giving troubles to her with an intention to grab her land. And forcibly they have taken her son from hostel. Out of the Ac 16.33 Cets an extent of Ac 3.00 acquired for land acquisition officer for the purpose of formation of
canal and the compensation was received by Keram Venkateswara Rao by plajing fraud, hence requested to take necessary action.
It is further submitted that after receiving the same the respondent police register the case in Cr. No. 107/2015 U/Sec 354.323.506. 447. r/w 34 IPC of Buttaigudem Police Station. The investigation officer took up the investigation during the course of investigation 4 witness were examined and recorded their statements. During the course of investigation it reveals that the husband of the petitioner was died on 2012, after that she along with her 3 children came to Buttaigudem, and she made illegal contact with one Nandyal Shekar. After knowing the above issue the son of the petitioner herein went to his Uncle's house Keram Venkateswara Rao.(brother of the petitioner's father). It is further submitted that the above said property was registered in the name of Keram Praveen Kumar (son of the petitioner).
It is also submitted that on 26.07.2015 when the petitioner tried to destroy the jam oil crop which were raised in to the above said land, hence the above said Keram Kannamma obstructed her to do so, hence the petitioner/Keram Rama seethe and Keram Kannamma quarreled with each other and the petitioner herein lodged complaint against the above said Keram Kannamma. In this case investigation yet to be completed. After completing the investigation, the respondent police will file final report before the Competent appropriate Court. Hence the allegations made against the respondent police are false and baseless."
3. On noticing the said written instructions, learned counsel for the petitioner requested this court to dispose of the writ petition by recording the said written instructions and further to direct the respondent police authorities to complete the investigation as expeditiously as possible.
4. In view of the above, writ petition stands disposed of, by recording the written instructions dated 11.09.2015, furnished by the
Station House Officer, Buttaigudem P.S., West Godavari District and the respondent police authorities are directed to complete the investigation, as expeditiously as possible.
5. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs. __________________ A.V.SESHA SAI, J 14th September, 2015 ss
