HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Criminal Petition No.4053 of 2017 ORDER:

This petition is filed by the petitioner/A.2 under Sec.437 and 439 Cr.P.C seeking regular bail in Crime No.32 of 2017 of Narsipatnam Prohibition and Excise Station, Visakhapatnam District, wherein he along with A.1 allegedly committed offence under Sec.8(c) r/w 20(b)(ii)(c) of NDPS Act.

2) It is seen that as per the occurrence report, 45 kgs of Ganja was found while it was being transported by A.1 and A.2 in an auto bearing No.AP 31 TG 1441, the auto was intercepted by the police of Prohibition and Excise P.S, Narsipatnam and the contraband was seized. Hence, the aforesaid crime.

3) Having regard to the fact that the contraband seized was a commercial quantity and investigation is pending, the bail application is dismissed with an observation that the same can be renewed after charge sheet is filed.
