The petitioner alleges that that even though the building permission was obtained on 17.12.2019 to construct the ground floor + 1 upper floor covering an area of 179.42 sq. meters in Sy.Nos.1415 and 1417 of Vemulavada Municipality, the respondent - municipality is interfering in the construction activity without any justification. 2.
The petitioner has enclosed the building permission granted by the respondent No.2 - municipality on 17.12.2019 as Ex.P1. It is not stated as to why the respondent No.2 - municipality is interfering when the permission is already granted and subsisting. 3.
However, without expressing any opinion on the merits, the writ petition is disposed of directing the respondent No.2 - municipality not to interfere with the construction activity of the petitioner as long as the building construction is strictly in accordance with the building permission granted on 17.12.2019 and no deviations are observed. However, this does not prevent the respondent No.2 - municipality from inspecting the construction and if it notices any illegal construction beyond the permissible limits, it is entitled to stop further construction and to take further course of action. 4.
