THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI WRIT PETITION No.10623 of 2010 ORDER:- This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue any writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondent in not paying the salaries to the petitioner as per the appointment order vide Memo No. 12576/H1/2007-5 dated 11-01-2008 is illegal, arbitrary and violative of article 14 of the Constitution of India and consequently direct the respondents to pay the salaries to the petitioner as per the appointment order vide Memo No. 12576/H1/2007-5 dated 11-01-2008 and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

I have heard the submissions of the learned counsel for the petitioner and the learned Assistant Government Pleader for Medical, Health and Family Welfare Department. I have perused the material record.

Learned counsel for the petitioner brings to the notice of this Court the interim orders, dated 30.04.2010, of this Court in W.P.M.P.No.13611 of 2010, which read thus:

"If the petitioner is working as Assistant Librarian as on today, he shall be paid salary as per memo bearing No.12576/H2/2007-5, dated 11.01.2008 and as extended by further orders, pending further orders.

Notice."

MSRM, J W.P.No.10623 of 2010 He further submits that pursuant to the interim orders, the salary is being paid accordingly and that in view of the compliance of the interim orders, the writ petition may be disposed of as no further orders are necessary.

Learned Assistant Government Pleader for Medical, Health and Family Welfare Department endorses the said submission.

Having regard to the submissions, the Writ Petition is disposed of holding that no further orders are necessary in view of the interim orders aforementioned which have been complied with. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
