THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.1294 of 2015 ORDER:
Upon hearing both sides, at the admission stage, the following Order is passed:
Having regard to the fact that complaint allegations disclose a prima facie accusation against the petitioners and the investigation is reported to be pending, it is not a fit case to quash the proceedings. However, the learned counsel for petitioners would submit that some of the employees of M/s Lavanya Broad Casting News, Visakhapatnam, forced to give a false complaint against the present accused and to that effect, the complainant has given a representation to the police also. Be that as it may, the truth or falsity of the complaint allegations has to be decided only after thorough and full fledged investigation. As the matter stands, the investigation shall go on for exhuming the truth. However, the Police of Gajuwaka, Visakhapatnam City, are directed to strictly follow the procedure contemplated under Section 41-A Cr.P.C.
towards the petitioners/Accused Nos. 1 to 5 during the course of investigation. The petitioners shall cooperate with the investigating agency for smooth completion of investigation. With the above observation, the Criminal Petition is disposed of. As a sequel, miscellaneous petitions, if any, pending shall stand closed.
