HON'BLE SRI JUSTICE S. RAVI KUMAR CIVIL MISCELLANEOUS APPEAL No.1047 of 2012 JUDGMENT :

This appeal is preferred against order dated 03.09.2012 in I.A.No.492 of 2012 in O.S.No.215 of 2012 on the file of Mahila Court-cum-VI-Additional District Judge, Visakhapatnam, whereunder Court below granted mandatory injunction directing respondent No.2-Greater Visakhapatnam Municipal Corporation (GVMC), Visakhapatnam, to remove the seal of plaint schedule shop pending disposal of the suit. Aggrieved by the order of mandatory injunction, GVMC preferred the present appeal.

2. As seen from the office note, the suit O.S.No.215 of 2012 was disposed of on 21.12.2012.

Though this appeal is posted under 'specially identified cases', no interest is evinced in prosecuting the case. Today neither advocate for appellant present nor any representation is made.

3. Considering these aspects, appeal is dismissed for non-prosecution.

4. Miscellaneous petitions pending, if any, shall stand closed. No costs.
