THE HON'BLE SRI JUSTI CE T.SUNI L CHOWDARY CRIMINAL REVISION CASE NO.3031 OF 2016 ORDER:

This revision case is filed by the petitioner under Sections 397 and 401 of the Code of Criminal Procedure (Cr.P.C.) challenging the docket order dated 19.09.2016 in C.C.No.70 of 2016 on the file of the XXIII Special Magistrate, Hyderabad.

Learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the revision case with liberty to appear before the trial Court and file a petition under Section 70(2) Cr.P.C. to recall non-bailable warrant issued against the petitioner. 3.

Permission is accorded.

The Criminal Revision Case is dismissed as withdrawn granting permission as prayed for. The trial Court is hereby directed to dispose of the petition under Section 70(2) Cr.P.C., if any, filed by the petitioner on the same day in accordance with law.
