THE HON'BLE SRI JUSTICE C.V.BHASKAR REDDY Contempt Case No.2306 of 2013 ORDER:

This Contempt Case is filed alleging violation of orders dated 13.12.2013 passed by this Court in W.P.M.P.No.45663 of 2013 in W.P.No.36719 of 2013.

By the above said interim orders, the learned Single Judge directed respondent No.2 therein to stop the illegal construction being made in the Rock Church premises at Asmangadh, Malakpet, Hyderabad, by respondent No.3 to 5, by converting the church building into a residential one, contrary to sanctioned plan.

A counter affidavit has been filed by the respondents stating that this Court was pleased to grant interim direction on 13.12.2013, but they have not received any copy of the said order. On 26.12.2013 the petitioner came to the church premises and created nuisance stating that this Court granted interim direction. Thereafter, the respondents have not proceeded with the construction having come to know about the granting of interim direction and they have also filed a vacate stay petition seeking to vacate the interim direction. As such there is no willful or deliberate violation on the part of the respondents.

Accordingly, this Contempt Case is closed. However, liberty is granted to the petitioner, if any cause survives, to file fresh application seeking revival of the contempt case in accordance with law.

Miscellaneous petitions, if any pending in this contempt case shall stand closed.
