THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.45327 OF 2016 ORDER :

Petitioner claims to have made an application for grant of quarry lease of Napa slabs in Sy.No.584/2, Rachamallapadu Village, Veldurthi mandal, Guntur District, to an extent of Ac.3.74 cents on 04.06.2016. This writ petition is filed alleging that the said application is not acted upon and so far quarry lease is not granted. According to the petitioner, he made similar application on 23.03.2010 to a larger extent of Ac.7.80 cents in the same survey number. On conduct of survey, a report was submitted on 18.12.2010 granting no objection for quarry lease. But no orders are passed on the said application. Petitioner seeks consideration of his application dated 04.06.2016 duly taking note of the No objection furnished by the Tahsildar, Veldurthi Mandal, Guntur District-5th respondent, on 18.12.2010.

Heard learned counsel for the petitioner and learned Government Pleader for Mines and Geology.

Learned Government Pleader submits that there is change in the procedure of issuance of No objection certificate after the year 2010.

Be that as it may, since the application submitted by the petitioner on 04.06.2016 is pending consideration of the 1st respondent, the 1st respondent is directed to consider the said application, take a decision on the entitlement of petitioner's claim for grant of quarry lease and whether the no objection certificate granted by the revenue authorities on 18.12.2010 is valid. If the No

objection certificate granted on 18.12.2010 is valid, the quarry lease may be processed accordingly. If for any reason, the 1st respondent does not accept the No objection certificate granted by 5th respondent on 18.12.2010, the same may be intimated to the petitioner. A decision to this extent shall be taken and communicated to the petitioner within a period of four (4) weeks from the date of receipt of copy of this order. 5.

With the above directions, the Writ petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
