THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.8653 OF 2022 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioner, who is arrayed as Accused No.1 in the event of his arrest in Crime No.225 of 2022 on the file of Sangareddy Rural Police Station, registered for the offence punishable under Sections 307, 195(A), 504 and 506 R/w 34 of Indian Penal Code.

Heard learned counsel for petitioner/Accused No.1 and learned Assistant Public Prosecutor for respondentState. Perused the record. 3.

The learned counsel for the petitioner seeks anticipatory bail to the petitioner on the ground that the petitioner has been falsely implicated in the present crime.

As seen from the complaint, the defacto complainant was threatened by the petitioner and two others forcing him to compromise with them in a criminal case. However, the petitioner and two others tried to attack the defacto complainant and the defacto complainant received severe bleeding injury on his right hand. It is not specifically stated that the petitioner has caused the said injury. In the said circumstances, the petitioner can be granted the relief of Anticipatory Bail. 5.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.1 shall be enlarged on bail in the event of his arrest subject to the following conditions: i) The petitioner/Accused No.1 is directed to surrender before the Station House Officer, Sangareddy Rural Police Station within one week from today, and on such surrender, he shall be enlarged on bail on executing his personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties to the like sum each, to its satisfaction.

ii) The petitioner/Accused No.1 shall appear before the concerned Station House Officer, every day at 10.00 AM for a period of one (01) month.

iii) The petitioner/Accused No.1 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. 6.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
