HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.25766 of 2018 ORDER:

This writ petition is filed challenging the look-out circular issued against the petitioner by respondents in connection with C.C.No.467 of 2015 on the file of learned XIII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad. The case of the petitioner is that in pursuance to the directions of this Court in WP.No.20721 of 2018, dated 08-06-2018, the petitioner approached the trial Court for release of the passport and thereafter, he made application for withdrawal of look-out notice and the same was returned by the trial Court on the ground that there is no provision to removal of look out circular. Aggrieved by the same, the present writ petition is filed.

Heard learned counsel for the petitioner and learned counsel for the 5th respondent.

This Court had an occasion to consider the similar issue in WP.No.13532 of 2018 and disposed of the same by its order dated 05-06-2018 directing the trial Court to consider such application.

In view of the same, for the reasons alike in the said order, the writ petition is also disposed of directing the XIII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad is directed to consider the application of the petitioner for recall of the lookout circular issued against the petitioner in accordance with law

keeping in view the facts and circumstances of the case, within a period of one week from today.
