CVNR, J & ANIS, J Dt: 17.04.2017 Judgment: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) Feeling aggrieved by Order and Decree, dated 30-12-2016, in FCOP.No.1713 of 2010 on the file of the Judge, Family Court, Hyderabad, whereby she has declared the A schedule property comprising gold jewellery as belonging to respondent No.1, respondent No.2 in the said FCOP filed this Family Court Appeal (FCA).

At the hearing, Mr.Ali Farooq, learned Counsel for the appellant, has conceded that FCA.No.139 of 2017, filed by the appellant against Order, dated 30-12-2016, in FCOP.No.227 of 2009, filed by respondent No.2 for mandatory injunction directing respondent No.3- Bank to permit him to use and operate the locker, remove A schedule jewellery and hand it over to the appellant, was partly allowed by this Court to the extent of one of the gold items forming part of the A schedule property in FCOP.No.1713 of 2010, while confirming the order of the Family Court in all other aspects. He has, however, agreed that in view of the said Judgment, separate adjudication of this FCA is unnecessary.

In the light of the above, this FCA is disposed of as infructuous.

CVNR, J & ANIS, J Dt: 17.04.2017 As a sequel to disposal of the FCA, interim order, dated 31.03.2017, is vacated and FCAMP.No.179 of 2017 is disposed of as infructuous.
