THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8238 of 2016 ORDER:

This Criminal Petition is filed by the petitioners/A-2 & A-3 under Section 438 Cr.P.C., seeking anticipatory bail in Crime No.259 of 2015, on the file of Amangal Police Station, Mahaboobnagar District, registered for the offences punishable under Sections 324 & 504 read with 34 IPC.

Heard and perused the material available on record. The allegations against the petitioners are that on 15.12.2015 at about 6.30 pm, when the de facto complainant and her husband were at their house, A-1 to A-3 came there in drunken state and started abusing them in filthy language and when her husband interrupted them, A-1 to A-3 beat him indiscriminately with sticks on his head causing bleeding injuries and immediately, the brother-in-law of the de facto complainant rushed to the place and rescued him and shifted him to the hospital. While undergoing treatment, he died on 17.01.2016 at 20.00 hours.

Learned counsel for the petitioners submitted that the petitioners are innocent of the offences alleged against them and with the instigation of some local leaders, the de facto complainant has foisted a false case against the petitioners. The learned Additional Public Prosecutor opposed this petition and submitted that there are specific overt acts against the petitioners herein and they are also evading arrest from the month of December, 2015.

Considering the facts and circumstances of the case and the submissions made by the learned Additional Public Prosecutor, this Court is not inclined to grant bail to the petitioners. Accordingly, the Criminal Petition is dismissed. ___________________ RAJA ELANGO, J
