THE HON'BLE SRI JUSTICE C.V.BHASKAR REDDY Contempt Case No.2004 of 2013 ORDER:

This Contempt Case is filed alleging violation of orders dated 05.11.2013 passed by this Court in W.P.M.P.No. 39007 of 2013 in W.P.No. 31399 of 2013.

By the above said order this Court has directed respondent Nos. 2 to 7 therein to consider the petitioner association representation and complaint and take immediate action for removal of unauthorized constructions which have been illegally and unauthorizedly set up by respondent No.8 therein which are causing hardship and inconvenience to the respondents. Today, when the matter is taken up for hearing, there is no representation on behalf of the petitioner. On 17.11.2022 also, since there was no representation for the petitioner, the matter was directed to be listed under the caption 'for dismissal'. This contempt case is pending from 2013 and cognizance was not taken as required under the provisions of the Contempt of Courts Act.

Learned Counsel appearing for the respondents has submitted that the orders of this Court dated 05.11.2013 have been complied by removing the encroachments raised by

respondent No.8 and as such prayed for dismissal of the contempt case.

Recording the submission of the learned Standing Counsel for respondents, this Contempt Case is closed. However, liberty is given to the petitioner, if any cause survives, to file fresh application seeking revival of the contempt case in accordance with law.

Miscellaneous petitions, if any pending in this contempt case shall stand closed.
