THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.10603 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.1 in Crime.No.257 of 2023 on the file of Abdullapurmet Police Station, Rachakonda, registered for the offence under Section 8(c) r/w. 20 (b) (ii) (c) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The petitioner and two others were arrested by Abdullapurmet Police for being found in possession of 2 packets of ganja amounting to 22 kgs. Having followed the procedure prescribed under NDPS Act, according to Police, they were remanded to judicial custody. The Police on completion of investigation filed charge sheet.

On instructions, learned Additional Public Prosecutor would submit that no other cases are pending against this petitioner.

In the said circumstances, the petitioner can be released on regular bail, subject to following conditions: i) The petitioner/Accused No.1 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties i.e, one local surety and the other from the native place, for a like sum each to the satisfaction of Metropolitan Sessions Judge, R.R.District, at L.B.Nagar.

ii) The petitioner/Accused No.1 after release shall appear before the concerned Court on every date of hearing.

iii) The petitioner/Accused No.1 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
