HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.7762 OF 2018 ORDER:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, is filed by the petitioners/A-1 to A-4 to quash the proceedings in C.C. No.820 of 2018 pending on the file of the Court of Additional Judicial Magistrate of First Class, Vizianagaram (for short, 'the trial Court'), registered for the offences punishable under Sections 498-A and 506 R/w.109 of IPC.

After arguing the case for awhile, learned counsel for the petitioners requested this Court to direct the trial Court to follow the procedure laid down by the Apex Court in Rajesh Sharma Vs. State of U.P.1. 3.

Acceding to the request of learned counsel for the petitioners, without touching the merits of the case, I find that it is a fit case to issue direction to the trial Court to follow the procedure laid down by the Apex Court in Rajesh Sharma (supra). Accordingly, the trial Court is directed to adhere to the guidelines issued in Rajesh Sharma (supra). 4.

With the above directions, the Criminal Petition is disposed of. Pending miscellaneous petitions, if any, in this Criminal Petition shall stand closed in consequence.
