HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.24914 of 2017 ORDER:
The petitioners complain inaction on the part of the 4th respondent in considering and passing orders on the request of the petitioners to mutate petitioners' names in the revenue records and not issuing pattadar passbook and title deeds, as illegal and arbitrary.
2. The Assistant Government Pleader (Revenue) on written instructions of even date submits that the matter has been enquired into by 4th respondent and petitioners' application is already rejected. The instructions do not refer to the date of proceedings through which such decision has been taken by 4th respondent.
3. Be that as it may, as the prayer is against inaction, this court cannot also expand the writ prayer. Hence, the writ petition is disposed of by placing on record the statement of 4th respondent and 4th respondent is directed to communicate the decision referred to above within four weeks from today. The petitioners are also given liberty to file a Memo by enclosing a copy of this order for due compliance. After the order is communicated, the petitioners are entitled to work out the remedies in accordance with law.
4. The writ petition is accordingly disposed of. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
