THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35089 of 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the inaction of the third respondent in investigating into crime No.484 of 2016 though the said crime is registered on 21.06.2016 as illegal and arbitrary, and also seeking a direction to the third respondent to complete the investigation and file charge sheet as expeditiously as possible.

Heard and perused the material.

Learned counsel for the petitioner submits that the petitioner lodged a complaint against the fourth respondent about his misbehaviour with her, but the third respondent/police is not proceeding with the investigation at the instance of the fourth respondent and as such, he prays this Court to direct the third respondent to complete investigation as expeditiously as possible.

Learned Assistant Government Pleader for Home (Telangana) submits that the third respondent is conducting investigation and would file the final report after completing investigation. Considering the rival submissions made by both the counsel, the writ petition is disposed of with a direction to the third respondent to conduct effective investigation and file final report, if any, in accordance with law.
