THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39972 of 2016 ORDER:
This writ petition is filed by petitioner under Article 226 of the Constitution of India seeking to declare the action of respondents 2 to 4 in not causing arrest and not filing final report against the accused in F.I.R.No.536 of 2015, dated 29-12-2015 registered under Sections 307, 294(b), 209, 384, 387, 388, 427, 506, 420, 468, 500 I.P.C. and Section 156(3) Cr.P.C. on the file of the 4th respondent, as illegal and arbitrary and consequently direct the respondents to cause immediate arrest of the accused in the said crime, including filing of criminal report in the matter. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home and perused the material available on record. The petitioner filed this writ petition challenging the inaction of respondents 2 to 4 in causing arrest and filing final report against the accused in the said crime. Taking into consideration the facts and circumstances of the case, this Court is of the view that the investigation can be completed expeditiously.
Accordingly, respondent No.4 is directed to complete the investigation expeditiously and file a final report, if any, in the above Crime, in accordance with law.
With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
