THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.8981 OF 2003 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: "to issue a writ, order or direction more particularly one in the nature of Writ of Certiorari calling for the records relating to the order made in the proceedings of the 2nd respondent bearing RC.No.298/200-E, dt:17-10-2001 as modified in the order made in O.A.No.119 of 2001 on the file of the 1st Respondent dt:20-1-2003 and quash the same as illegal, arbitrary and violative of statutory provisions and the principles of natural justice and consequently direct the respondents to drop all further proceedings against the petitioner in this regard."

After arguing for sometime, learned counsel for the petitioner confined his arguments only to the extent of reducing the rate of interest fixed by respondent No.1 - The A.P. Cooperative Tribunal at Vijayawada, Krishna District in O.A.No.119 if 2001 vide order, dated 20.01.2003, whereunder and whereby, respondent No.1 has modified the rate of interest granted by respondent No.2 - The Deputy Registrar of Cooperative Societies, Kakinada, East Godavari District by reducing the same from 27% to 15%. Learned counsel prayed to reduce the rate of interest by taking into consideration the lapse of time and also the age of the petitioner and his family conditions.

Considering the facts and circumstances of the case, without expressing any opinion on merits, since the prayer of the petitioner is only to the extent of reducing the rate of interest, the rate of
interest is hereby modified by reducing the same from 15% to 7%. Rest of the order under challenge is not interfered with. 4.
Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this writ petition shall stand closed.
