CVNR, J & TR, J FCA.No.28 of 2017 Dt: 11.04.2017 Judgment: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) Order and Decree, dated 04-09-2014, in OP.No.42 of 2013 on the file of the Judge, Family Court -cum- Additional District & Sessions Judge, Nalgonda, are assailed in this Family Court Appeal (FCA).
By the afore-mentioned order, the Family Court has granted decree for restitution of conjugal rights. During the hearing of this case, on the suggestion made by this Court, both parties have entered into an out of Court settlement, following which they have filed OP.No.2 of 2017 under Section 13-B of the Hindu Marriage Act, 1955, for dissolution of marriage by mutual consent. In terms of the understanding between the parties, the appellant has also deposited a sum of Rs.12 lakhs to the credit of the said OP, which the respondent is entitled to withdraw at the time of disposal of the OP subject to her withdrawing CC.No.1055 of 2014 from the file of the Judicial First Class Magistrate, Nalgonda, and EP.No.1 of 2014 from the file of the Junior Civil Judge, Nalgonda.
Today, both the parties are personally present. The learned Counsel representing them submitted that in view of the above subsequent events, FCA need not be adjudicated on merits.
CVNR, J & TR, J FCA.No.28 of 2017 Dt: 11.04.2017 Accordingly, the FCA is disposed of as infructuous. As a sequel to disposal of the FCA, FCAMP.No.42 of 2017, filed by the appellant for interim relief, is disposed of as infructuous.
