ORDER:

The case of the petitioners is that the subject property standing in the name of grand father, which is also reflected in the municipal records, is now sought to be changed at the instance of one of the sons of grand father and in such an event, grave prejudice would be caused to the petitioners. A false document was created by one of the sons of grand father and based on that, false registration has taken place in favour of the third respondent and based on the said transactions, an endeavour is made to change the municipal records also. Having come to know about the same, the petitioners have filed objections before the Commissioner, Korutla Municipal Council, Korutla Town, Karimnagar District (1st respondent) on 06.04.2015.

Learned counsel for the petitioners submits that a notice was issued to the petitioners by the 1st respondent Municipal Council on 08.08.2015 asking the petitioners to submit registered documents in respect of the subject property within three (3) days and in response to the said notice, reply notice on behalf of the petitioners was given to the 1st respondent Municipal Council on 28.08.2015. Learned counsel for the petitioners further submits that the only request of the petitioners is to give a direction to the 1st respondent Municipal Council to consider their objections before undertaking mutation of municipal records.

3. Having regard to the fact that the representation submitted by the petitioners on 06.04.2015 is pending

consideration by the 1st respondent Municipal Council, the Writ Petition is disposed of by directing the 1st respondent Municipal Council to consider the representation, dated 06.04.2015, and reply notice submitted by the petitioners on 28.08.2015 opposing the change of mutation in the municipal records, if necessary by putting respondents 2 and 3 on notice and giving them due opportunity. There shall be no order as to costs.
