HON'BLE SRI JUSTICE R.SUBHASH REDDY AND HON'BLE SRI JUSTICE A.SHANKAR NARAYANA WRIT PETITION No.30682 of 2015 ORDER : (per Hon'ble Sri Justice R.Subhash Reddy) This writ petition is filed by the petitioners challenging the order dated 26.08.2015 in C.C.No.6 of 2008 passed by the District Consumer Forum, Warangal, as arbitrary and illegal.

2. Respondent Nos.1 to 4 herein are the complainants in C.C.No.6 of 2008 on the file of the District Consumer Forum, Warangal. Through the impugned order dated 26.08.2015, the District Consumer Forum, Warangal, has passed orders directing the opposite parties therein jointly and severally to pay a sum of Rs.1,00,000/- for causing inconvenience towards illegal construction made by them. As against the said order, the petitioners/opposite parties carried the matter by way of appeal before the Telangana State Consumer Disputes Redressal Commission, Hyderabad. As the State Commission was not functioning earlier, the petitioners have approached this Court by way of filing the present writ petition.

3. This Court, while issuing notice before admission, by order dated 21.09.2015, granted interim suspension of the impugned order dated 26.08.2015.

4. Today, when the matter is called for hearing, it is represented that pursuant to the appointment of President, the State Commission has started functioning.

5 . In view of the said submission, since the F.A. filed by the petitioners is pending before the Telangana State Consumer

Disputes Redressal Commission, Hyderabad, we deem it appropriate to dispose of the writ petition permitting the petitioners to pursue the appeal pending before the Telangana State Consumer Disputes Redressal Commission, Hyderabad. Interim order dated 21.09.2015 passed by this Court shall remain in force for a further period of four weeks from today.

6. Subject to the above direction, this writ petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
