Kadavath Sawai Singh v. The State Of Telangana,
THE HON'BLE SRI JUSTI CE A.V.SESHA SAI W.P.No.5721 of 2017 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India, for the following relief:
"To issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, to declare the action of the 3rd respondent in not restoring the cheque drawing power inspite of the orders passed by the 2nd respondent dt. 4-2-2016 in Procs. No.B5/2014 followed by written representation dt.19-9-2016 and personal visits, as being illegal, arbitrary and unjust and consequently direct the respondent authorities to restore the cheque drawing power".
2.
The grievance of the petitioner in the present Writ Petition is that despite the orders of the District Collector-2nd respondent vide proceedings No.B5/451/2014 dated 4.2.2016, dropping further action, the Respondents 1 and 3 are not restoring the cheque power of the petitioner. It is further stated that the petitioner herein submitted a representation dated 19.9.2016 to the 3rd respondent-District Panchayat Officer, Nizamabad for restoration of the cheque power, but no action has been taken so far.
3.
Having heard the learned counsel for the petitioner and the learned Government Pleader appearing for Respondents, this Court is of the considered view that ends of justice would be served if the 3rd respondent-District Panchayat Officer is directed to take appropriate action on the representation of the petitioner dated 19.9.2016 pursuant to the proceedings of the District Collector vide proceedings dated 4.2.2016.
4.
For the aforesaid reasons, the writ petition is disposed of, directing the 3rd respondent-District Panchayat Officer to take action on the representation of the
petitioner dated 19.9.2016 in terms of the orders of the 2nd respondent-District Collector vide proceedings No.B5/451/2014 dated 4.2.2016 within a period of one month from the date of receipt of this order. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs. ______________ A.V.SESHA SAI, J Date: 3.3.2017 DA
