The petitioner prays for the following relief: "....this Hon'ble Court may be pleased to issue a Order, Direction or Writ, more particularly Writ of Mandamus, declaring the action of the respondents in interfering and threatening for dispossession of the petitioner from the land to an extent of Ac. 3-64 cents in survey No. 272 of Devalampeta Village, Vedurukupam Mandal Chittoor District as illegal, arbitrary and against the principles of natural justice and against well settled principles of law and consequently direct the respondents not to interfere and not to dispossesses without following the due process of law and to pass....."
The prayer is against threatened dispossession of petitioner from land referred above without recourse to law. On 22.04.2016, this Court granted the following interim order: "Pending further orders, respondents shall not interfere with the peaceful possession and enjoyment of the petitioner over the subject land, without following due process of law".
The prayer in the writ petition is to follow the procedure stipulated by law before dispossessing the petitioner from the land. The prayer of petitioner is in line with the requirement of rule of law. This Court is of the view that respondents 2 to 4 issue notice, afford opportunity, pass orders and thereafter interfere with the possession of the petitioner.
Hence, the writ petition is disposed of by directing the respondents not to disturb the possession of petitioner, except in
accordance with law. The proposed action is to be initiated if available and circumstances warrant. There shall be no order as to costs.
Consequently, pending miscellaneous petitions, if any, stand closed.
