HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.4755 of 2017 ORDER:
There is no representation for the petitioner. Perused the writ petition with the supporting affidavit and heard the learned Government Pleader for Endowments for respondent Nos.1 & 2 and also learned Standing Counsel for respondent Nos.3 to 5 Temple and perused the counter of the 5th respondent.
The counter of the 5th respondent is very clear that as per the temple traditions and customs of the practice in vogue of receiving any Swamiji or Peetadhipathi from the 6th respondent claim is that unaware of any antecedents of him have received with honour and provided darshan of God and Goddess and they committed no sin therein and what are the averments of the petitioner that the 6th respondent was indulging in digging hidden treasures and doing black magic on Amavasya and if at all with knowledge or without knowledge of the respondents supra.
Having regard to the above, the Writ Petition is dismissed by left open to the petitioner even he can maintain any criminal proceeding as a person interested to the interest in the society against such so called criminal with criminal background by filing private complaint or giving information to the police and to proceed according to law if there is any cognizable offence. Consequently, miscellaneous petitions, if any shall stand closed. No costs.
