HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO Tr.CRIMINAL PETITION No.221 of 2015 ORDER :

The present transfer criminal petition is filed by the petitioners under Section 407 Cr.P.C seeking to transfer C.C. No.200 of 2013 on the file of Judicial Magistrate of the First Class, Hindupur to any other Court outside the district of Anantapur.

2) Heard the learned counsel for the petitioners as well as the 1st respondent-State represented by the Public Prosecutor before admission and before ordering notice to respondent Nos.2 and 3 and perused the material on record.

3) The only allegation is that there is a threat of harm from accused persons for entering Hindupur for attending the Court saying accused are residents of Hindupur, whereas the complainant is resident of Davangere, Karnataka State which is boarder to Anantapur District. It is the submission that there is no earlier police report but for filed a writ petition, however, it is in relation to the police threatened arrest, for not to interfere with personal liberty.

4) Having regard to the above, there are no grounds to admit the application but for disposal by directing the police, Davangere, to provide police assistance to the complainant by collecting of usual charges for his attending to Court at Anantapur as and when required and coming back to his home.

5) With the above observations, the criminal petition is disposed of. Consequently, the miscellaneous petitions, if any pending, shall stand closed.
