HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.9048 of 2015 Order:

This Writ Petition was filed for the following relief. "To issue a Writ of Mandamus or any other appropriate Writ or order or direction and declare, as ultra vires of the power of the 2nd respondent and as arbitrary, illegal and as unjust the impugned notice dated 25.02.2015 of the 2nd respondent proposing to sell the schedule mentioned land by way of public auction and issue a consequential direction directing the 2nd respondent not to proceed further with the said sale/auction of the schedule mentioned land pursuant to the impugned notice." Since the auction was conducted pending disposal of the Writ Petition, Sri S. Satyanarayana Prasad, learned Senior Counsel appearing for the petitioners, seeks permission of this Court to withdraw the Writ Petition with liberty to file fresh Writ Petition challenging the auction held, if any.

Permission is accorded and, accordingly, the Writ Petition is dismissed as withdrawn granting liberty to the petitioners to file fresh Writ Petition challenging the auction held, if any. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
