Petitioner challenges the provisional assessment notice issued in respect of SC.No.A2035522 dated 02.09.2016.

I have heard counsel for petitioner and learned standing counsel for respondents.

This Court is of the view that the petitioner can file reply and allow the second respondent to take final decision in this behalf. Petitioner could not make out case for accepting the challenge to the notice impugned in the writ petition. Petitioner is given liberty to deposit Rs.42,232.50 + compounding amount within one week from today and also submit his reply to second respondent. The second respondent is directed to take a decision in accordance with law within a further period of four (4) weeks therefrom. Till a decision is taken and communicated to petitioner, the subject service connection shall not be disconnected.

The writ petition is disposed of. As a sequel, the miscellaneous petitions, pending if any, shall stand closed. There shall be no order as to costs.
