THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No. 25060 OF 2015 This writ petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue an appropriate order or direction more particularly one in the nature of a Writ of Mandamus, by declaring the action of the respondents in calling the petitions to the I town Police Station, Miryalaguda as illegal and unconstitutional and violation of Article 21 of the Constitution of India and consequently direct the respondent not to call the petitioners to the I town police station, Miryalaguda as such this Hon'ble Court may deem fit and proper in the circumstances of the case." 2.

When the matter is called today, written instructions dated 13.08.2015, furnished by the Circle Inspector of Police, Miryalaguda I Town Police Station, Nalgonda District, have been placed on record by the learned Government Pleader for Home and the said instructions read as under:

"It is respectfully submitted that, the 4th respondent along with his Uncle approached this respondent police station and made oral complaint against the petitioners' herein stating that the petitioners are not paying the amount which he had given to them as loan, and requested to take necessary action against the petitioners herein. In this regard this respondent made a phone call twice to the petitioners to enquire into the matter and advice to settle the matter, thereafter, this respondent never called the petitioner through phone call or called to the police station as the matter pertains to civil in nature suggested the 4th respondent and his Uncle to settle the matter through proper channel. It is respectfully submitted that, the petitioner contended that the Circle Inspector of Police threatened the petitioners to pay the money to the 4th respondent

otherwise he will register a case and arrest them and used filthy language against the petitioners is denied. This respondent never called the petitioners to the police station except calling on phone only for twice to know the facts as per the oral complaint made by the 4th respondent herein, therefore, calling the petitioners to the police station and threatened them does not arise. As such, all the allegations made by the petitioner in the present writ petition against this respondent, is totally false and baseless, hence denied."

3. On noticing the said instructions, learned counsel for the petitioner has requested this court to dispose of the writ petition by recording the said instructions.

4. In view of the above reasons, writ petition is disposed of, by recording the written instructions dated 13.08.2015 furnished by the Circle Inspector of Police, Miryalaguda I Town Police Station, Nalgonda District.

5. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs. __________________ A.V.SESHA SAI, J 17th August, 2015 ss
