HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.1002 OF 2017 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking to declare the inaction of the respondents in conducting survey for demarcation of petitioner's lands in survey No.841/3 admeasuring Ac.0-18 cents and survey No.842/7 admeasuring Ac.0.03 cents situated at Peddapur Village, Julapalli Mandal, Peddapalli District, as illegal and arbitrary.
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue for respondents. With their consent, the Writ Petition is disposed of at the stage of admission itself.
The limited grievance of the petitioner in this writ petition is that though he submitted representation to the 4th respondentTahasildar for conducting survey in respect of the lands belonging to the petitioner, till date no orders are passed. Learned AGP submits that a suitable direction may be given to the 4th respondent to consider the representation submitted by the petitioner, if not already considered, in accordance with law. Having regard to the rival submissions made, the Writ Petition is disposed of directing the 4th respondent-Tahasildar to deal with the representation submitted by the petitioner by paying necessary fee on 07.09.2016 for conducting survey to demarcate lands in survey No.841/3 admeasuring Ac.0-18 cents, survey
No.842/7 admeasuring Ac.0.03 cents situated at Peddapur Village, Julapalli Mandal, Peddapalli District, in accordance with law, at the earliest, preferably within a period of eight weeks from the date of receipt of a copy of this order.
