HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 21462 of 2014 Order:
This Writ Petition was filed challenging the inaction of the respondents in granting final registration certificate on the application submitted by the petitioner seeking permission to undertake Aquaculture activity in R.S.No.81 in an extent of Ac.2.95 cents, situated at Nelamuru village, Penumantra Mandal, West Godavari District. This Court, by order dated 30.07.2014, permitted the petitioner to carry on digging operations but he was restrained from commencing the Aquaculture activities till final registration is granted. It was also made clear that the digging operations would be subject to further orders of the District Level Committee and the petitioner shall not claim any equity. The third respondent was directed to dispose of the application filed by the petitioner on 30.02.2014.
Now, a counter affidavit is filed stating that at the time of inspection by the inspection committee the surrounding paddy farmers have opposed the conversion of agricultural land for Aquaculture activity and basing on the same the inspection committee had rejected to recommend the application by its letter dated 19.06.2014. The application of the petitioner was placed before the District Level Committee and the rejection by the inspection committee was accepted and the application was disposed of on 06.02.2015 rejecting the application. It was also stated that an appeal is provided to the Commissioner of Fisheries, Hyderabad as per G.O.Ms.No.7 dated
16.03.2013. In view of the same, no further orders are necessary in the present Writ Petition.
The Writ Petition is, accordingly, closed. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
