HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39881 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to quash the proceedings against her in Crime No.190 of 2012 on the file of Kandukur Police Station, Cyberabad District. 2.

Heard and perused the material available on record. 3.

It is stated in the affidavit that the petitioner herein purchased agricultural land from one Mohammad Hafeez in the year 1994 and after demise of her vendor, the widow of her vendor made claims questioning the legality of ROR proceedings before the revenue officials and those proceedings were dismissed. Then, the widow of the vendor of the petitioner filed a writ petition before this Court and this Court gave an interim direction to enquire into the Executive Actions of the official respondents therein. Then, the 3rd respondent addressed a letter to the Station House Officer to launch prosecution. Hence, the present crime was registered for the offence under Sections 420, 468 and 471 IPC. It is the case of the petitioner that without there being any complaint for commission of the said offences, the above crime was registered and that the petitioner has not committed any offence. 4.

The petitioner filed this writ petition challenging the investigation in the above crime. This Court is not inclined to interfere with the investigation in the above crime. However, as the present crime pertains to the year 2012, respondents Nos.1 and 2 are directed to complete the investigation and file a final report, in accordance with law, without arresting the petitioner. The petitioner is directed to appear before the

Station House Officer concerned as and when required and she is also directed to execute a personal bond for a sum of Rs.5,000/- (Rupees Five Thousand only) with one surety for the like sum to the satisfaction of the Station House Officer concerned, as surety for her future appearance as and when required for the purpose of investigation. 5.

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ________________ RAJA ELANGO, J Date: 23rd December, 2016 Nn
