THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No. 1917 OF 2018 O R D E R :
Complaining wilful disobedience of the order dated 22.02.2018 in Writ Petition No. 4762 of 2018, the petitioner filed this Contempt Case.
Through the order dated 22.02.2018, this Court directed the respondent herein to consider the case of the petitioner and pass appropriate orders by providing relief subject to the rules permitting, within eight weeks from the date of receipt of a copy of that order.
Pursuant to the notice issued in the Contempt Case, the respondent filed an affidavit. In paragraph 14 thereof, it has been stated that as per the report of the Tahsildar, Renigunta and on verification of the records, an endorsement was issued to the petitioner vide Roc.No. G2/1712/2018, dated 04.09.2018 stating that the representation of the petitioner cannot be considered for payment of compensation / ex-gratia as the lands were resumed to government in 1982 itself, under B.S.O. 15(18) read with Condition No. 17 of the 'D' form for establishment of Railway Carriage Workshop at Renigunta.
In view of the categorical averments in the affidavit, since the respondent, as directed by this Court, had considered the case of the petitioner and issued an endorsement stating that her representation cannot be considered for payment of compensation / ex-gratia as the lands were resumed to government, there cannot be any contempt on the part of the respondent. If the petitioner is
aggrieved with the said endorsement, she is at liberty to challenge the same, if she is so advised.
