This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused No.4 in Crime No.37 of 2025 of Jannaram Police Station, Mancherial District.

The brief facts of the case are that on 25.02.2025 at Gandhinagar Street, Ponkal village, the accused Kunta Gangulu, his wife Gangavva, his son Thirupathi, and his daughter Anjali, with a common intention, assaulted the complainant's mother Kunta Laxmi with a stone on her head over a dispute relating to Rs.20,000/- borrowed by accused No.1, causing severe bleeding injuries. When the complainant Kunta Ravi, his elder brother Kunta Murali, and Murali's wife Kunta Saroja rushed to rescue her, the accused attacked them with an axe and sticks, resulting in severe bleeding injuries on their heads and hands.

Heard Sri N. Venkataiah, learned counsel appearing on behalf of the petitioner as well as Sri E. Ganesh, Assistant Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the allegations made against her and that the case was falsely registered and that there was a delay of one week in lodging the report before the police, as the incident allegedly occurred on 25.02.2025, but the report was lodged only on 01.03.2025. He further submitted that the petitioner was pregnant at the time of the incident, later delivered a baby in the month of July, and subsequently lost the baby, which left her in depression. A medical certificate was also filed in support of this contention. He contended that the investigation has been completed. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this criminal petition.

On the other hand, learned Assistant Public Prosecutor opposed the petition stating that the victim had sustained grievous injuries, the investigation was not yet completed, and
the petitioner had been absconding. Therefore, he prayed the Court to dismiss the criminal petition.

In light of the submissions made by both the learned counsel and upon perusal of the material available on record, it is seen that the petitioner has been arrayed as accused No.4. The allegation against her is that she, along with her mother, beat the victim with a stick. However, the document filed by the petitioner shows that she was pregnant on the date of the incident. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to the following conditions: i.
The petitioner shall surrender before the Station House Officer, Jannaram Police Station, Mancherial District, within two weeks from today, and on such surrender, the said Station House Officer shall release her on bail on executing a personal bond for Rs.25,000/- with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha
Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required 7.
Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
