O R D E R

This criminal petition is filed under Section 482 of Cr.P.C. to quash the charge sheet in C.C.No.184 of 2016 on the file of II Additional Magistrate of First class, Bhimavaram, West Godavari District, filed against the petitioners, who are A-1 and A-2, for the offences punishable under Sections 341 and 506 read with 34 IPC.

Heard the counsel for the petitioners/accused and the learned Additional Public Prosecutor, representing the State. Specific allegations were made against the petitioners in the complaint. The truth or otherwise of the allegations can only be decided during the course of trial. This court is not supposed to make a roving enquiry into the allegations made in the charge sheet. I see no grounds to quash the charge sheet.

In the facts and circumstances of the case and as requested by the learned counsel for the petitioners, the criminal petition is disposed of, directing the trial court to proceed with the trial and dispose of the same as expeditiously as possible, without insisting the presence of the petitioner No.2 / accused No.2 on each and every date of hearing, except required for any specific purpose. However, petitioner No.1 / accused No.1 shall appear before the trial court.

Pending miscellaneous applications, if any, shall stand closed. No costs.
