THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.396 of 2016 ORDER:

This revision is preferred challenging the order, dated 04.01.2016, passed in Crl.M.P. No. No.645 of 2015, in Crime No.8/ACB.CR.I/2014 on the file of the Principal Special Judge for SPE and ACB Cases , City Civil Courts, Hyderabad. Heard and perused the material available on record. The case of the petitioner is that she is the youngest daughter in law of the accused officer and she is living along with her husband in USA. When the petitioner was proceeding to USA, she kept her gold ornaments i.e. Sl.No.1 to 7 in the inventory proceedings, in her in-laws' house. At the time of search proceedings in the house of the accused officer, the said gold ornaments were seized by the investigating officer.

Therefore, the petitioner filed the impugned application before the Court below through her special power of attorney holder to return the said gold ornaments. The Court below while allowing the said application, directed the special power of attorney holder of the petitioner to furnish a bank guarantee for Rs.5,60,000/- and also on executing a self bond for that amount by the GPA holder. Aggrieved over the same, the present revision is filed.

The gold ornaments shown at Sl.No.1 to 7 of inventory proceedings, dated 03.04.2014, shall be returned to the petitioner through her special power of attorney holder, by name, Sri V. Srinivasulu on his execution of a personal bond for a sum of

Rs.2,00,000/- (Rupees two lakhs only).

Accordingly, the Criminal Revision Case is disposed of. Consequently, the Miscellaneous Petitions pending, if any, shall stand closed.
