Date : 16.2.2017 Between :

The Secretary to Govt, I & CAD Department of AP Hyderabad and others Petitioners And The chairman cum Presiding Officer, Industrial Tribunal cum Labour Court, Anantapur and another Respondents The Court made the following:

ORAL ORDER:

This writ petition is filed aggrieved by the award in I.D No. 82 of 2005 on the file of the Industrial Tribunal cum Labour Court, Anantapur (for short Labour Court). The Labour Court partly allowed the writ petition, whereby the oral order of termination/ retrenchment with effect from 11.10.2002 was set aside and direction was issued to reinstate the petitioner therein to service with continuity of service but without attendant benefits and backwages. At the stage of admission, this Court was assured that the award of the Labour Court would be implemented. Recording the statement, six weeks time was granted on 19.2.2010 and in the mean time, the attachment order was suspended. It is thus clear that second respondent/workman must have been reinstated and continuing in service. This may be the reason, parties are not interested in prosecuting the writ petition.

There was no representation on 9.2.2017 and today also there is no representation. In the circumstances, the writ petition is dismissed for non prosecution. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed.
