The petitioner is A.1 among three accused of Cr.No.91 of 2018 of Alipiri Police Station, chittoor District, registered for the offences punishable under Section 324 r/ w 34 IPC later altered to Section 307 r/ w 34 IPC., now seeking anticipatory bail.
Heard the learned counsel for the petitioner and the learned Addl.Public Prosecutor for the respondent-State who opposed the bail and perused the bail application averments, First Information Report and earlier dismissal order of the bail application of the petitioner in Crl.M.P.No.1386 of 2018 passed by the learned Sessions Judge, dt.17.07.2018 even after considering the fact that the A.2 and A.3 were granted regular bail while in judicial custody since 13.04.2018 in Crl.M.P.No.850 of 2018, dt.03.05.2018.
A perusal of the material on record including from the remand report of A.2 and A.3 particularly from internal page 3 para-1 shows the petitioner is not entitled to the concession of anticipatory bail, however it is not a bar to surrender and move for regular bail and the available contentions are left open to the petitioner/ A.1. In the result, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed. __________________________ Dr. B.
