HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.7282 of 2017 ORDER:

Heard learned counsel for the petitioner/ A.4 of Crime No.66 of 2017 on the file of the Steel Plan Police Station, Visakhapatnam, registered for the offences punishable under Sections 420 and 403 r/ w 34 IPC and learned Public Prosecutor representing the State before ordering notice to respondent No.2 and perused the grounds urged in the quash petition and F.I.R.

A Perusal of the grounds in the quash petition, though there is a force in the contention of the dispute between the de facto complainant and his daughter, the de facto complainant tried to involve the petitioner/ A4 and other employees of her and there is no basis as to how, to whom and what document executed and how the petitioner among others are concerned and even from the perusal of the very report, there is no whisper against the petitioner, but for, against his daughter and Santhosh Singh/ A2 if at all any privy for the so called sale of the machinery lying at Steel Plant, where he was doing contract works with that machinery, that was allegedly sold by his daughter.

Dr.SSRB,J Having regard to the above, though there is nothing to interdict the investigation, there is stay of arrest of the petitioner pending investigation.

Accordingly, the Criminal Petition is disposed of. Further remedies are left open.

Pending miscellaneous petitions, if any, shall stand closed.
