THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.25840 of 2018 ORDER:

Heard Mr.A.Eshwar for petitioner and the learned Assistant Government Pleader (Revenue) for respondents 1 to 3. The petitioner challenges the order dated 12-04-2018 passed under the A.P. Assigned Lands (POT) Act, 1977. Mr.Eshwar, though made a few submissions to convince this Court for entertaining the writ petition against the order impugned in the writ petition, finally submits that the petitioner is prepared to work out the remedy of appeal and the interest namely, preservation of property and possession may be considered by this Court.

The request of Mr.Eshwar is not opposed by the learned Assistant Government Pleader.

The following order, hence is passed.

(a) The petitioner is given liberty to file appeal before the 2nd respondent/Revenue Divisional Officer within four (04) weeks from today, by enclosing a copy of this order.

(b) The appellate authority/Revenue Divisional Officer considers and disposes of the appeal, by referring to each one of the grounds raised by the petitioner, as expeditiously as possible, preferably within four (04) months from the date of filing of the appeal.

(c) The parties are directed to maintain status-quo as regards possession and physical features of subject plot, during the pendency of appeal and till the order is made and communicated.

Writ petition is accordingly disposed of. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
