HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO TRANSFER CRIMINAL PETITION Nos.263 and 264 of 2013 COMMON ORDER:

These petitions are filed under Section 407 of the Code of Criminal Procedure, seeking transfer of M.C.No.4 of 2012 on the file of Principal Junior Civil Judge, Kovvur and C.C.No.267 of 2013 on the file of II Additional First Class Judicial Magistrate, Kovvur, to any competent Court in Vijayawada. Heard both sides.

A perusal of the record shows that there are no grounds to transfer the above said cases as sought for, merely because, the petitioner is working in B.S.N.L., Vijayawada, whereas the 2nd respondent/wife is shown as resident of Kovvur, but for, to say the petitioner is given liberty to file applications under Section 205 Cr.P.C. to represent through special vakalat holder, subject to personal appearance as and when required, in the above said cases under Section 126(2) r/w 205 Cr.P.C.

Accordingly, Transfer Criminal Petitions are disposed of. Miscellaneous petitions pending, if any, shall stand closed. _________________________ Dr. B. SIVA SANKARA RAO, J
