The action of respondents 2 to 4 herein, in conducting auction of the petitioners' land of an extent of Ac.1.09 cents in Survey No.94/1 and Ac.1.40 cents in Survey No.190/3 of Saripalle Village, Ganapavaram Mandal, West Godavari District, inspite of the pending suits, is questioned in this writ petition as being arbitrary and illegal. The auction notice dated 19.05.2011 was issued inviting bids for grant of leasehold rights of the subject land for a period of three years. By the interim order, in WPMP.No.17645 of 2011 dated 31.05.2011, the petitioners were also permitted to participate in the auction proposed to be held.

The three year period of lease, stipulated in the impugned notice dated 19.05.2011, expired on 19.05.2014 or soon thereafter, i.e more than three years ago. It is evident, therefore, that the cause in the writ petition no longer survives, and the writ petition has become infructuous.

The Writ Petition is, accordingly, dismissed as infructuous. Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
