HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 33750 OF 2017 ORDER:

Heard learned counsel for the petitioner and Sri M.S.R.Chandra Murthy, learned Standing Counsel for 3rd respondent.

It is the case of the petitioner that though Appeal No.33599 is pending before the 2nd respondent against orders of recovery, the respondents are initiating proceedings under Revenue Recovery Act.

Sri M.S.R.Chandra Murthy, learned Standing Counsel for 3rd respondent produced proceedings No.3305/2014APE/Mgr, dated 24.04.2017 stating that the appeal filed by the petitioner was rejected.

On the other hand, learned counsel for the petitioner submits that the said order is not served on the petitioner. Now, a copy of aforesaid order dated 24.04.2017 is served on the learned counsel for the petitioner by the learned Standing Counsel for 3rd respondent.

Since a copy of the order dated 24.04.2017 is served on the learned counsel for the petitioner, he seeks permission of this Court to withdraw the writ petition with liberty to challenge the said proceedings of the District Collector.

Accordingly, learned counsel for the petitioner is permitted to withdraw the writ petition with liberty sought for. However, there shall be interim stay of proceedings in Rc.No.115/2017, dated 04.09.2017, for a period of two weeks enabling the petitioner to challenge the proceedings of the District Collector dated 24.04.2017.

Accordingly, this writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition, shall stand disposed of.
