THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR Writ Petition No.1877 of 2015

Order: (per the Hon'ble the Chief Justice Sri Kalyan Jyoti Sengupta) This writ petition is disposed of after hearing the learned counsel for the parties and we are of the view that at this stage, this Court can pass the following orders:

The petitioner shall deposit the tax amount allegedly demanded by the respondent-authorities and on such deposit being made, the vehicle shall be released forthwith.

Learned counsel for the petitioner says that the demand raised by the respondent-authorities for which the vehicle has been seized is not legally justifiable. His client has accordingly made a representation to that effect. We therefore direct the 2nd respondent to consider the representation made by the petitioner in accordance with law within a period of three weeks from the date of communication of this order. The deposit so made, will abide by the result of the decision so to be taken by the 2nd respondent. The writ petition is accordingly disposed of. Consequently, the miscellaneous applications, if any pending, shall also stand closed. No order as to costs.
