Dontha Dhananjay v. The State Of Telengana
HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.25936 of 2018 ORDER:
This writ petition is filed with the following prayer: "......to issue appropriate Writ, direction, or order more particularly one in the nature of Writ of Mandamus or any other Writ or order/direction to respondents 3 and 4, not to abuse their power and not to harass petitioner in order to recover money due by one Sri Raju or any other person or persons to respondents 5 and 6 and further not to interfere in any civil disputes, and pass such further and other orders as may be found expedient under the circumstances."
Learned Assistant Government Pleader for Home produced written instructions stating that basing on the complaint of one Ramuni Rama Krishna, a case in Cr.No.37 of 2018 for the offence punishable under Section 420 IPC was registered against the petitioner and another and investigation is pending in the said case. Since the date of registration of FIR, the petitioner and other accused are absconding. The other allegations regarding pressurizing the petitioner to pay amounts and to settle the civil disputes in favour of respondents 5 and 6 are denied. Recording the same, the writ petition is disposed of. However, it goes without saying that the respondent-police shall not interfere with the civil disputes pending between the petitioner and respondents 5 and 6 or pressurize the petitioner to settle disputes with them. However, this order will not preclude the respondentpolice from investigating into any case registered against the petitioner. No order as to costs.
As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 02-08-2018 Nvl
