THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3537 of 2016 ORDER:
1. This Criminal Petition is filed by the petitioners-accused Nos.1 and 2 seeking to quash the proceedings against them in C.C.No.877 of 2015 on the file of the Judicial Magistrate of First Class, Naidupet.
2. The petitioners are alleged to have committed the offence punishable under Sections 353 r/w 34 IPC. It is alleged that when the 2nd respondent-police constable asked A1, who came on a motor cycle, to show the papers of the bike to his superiors, he failed to show the same and therefore, a fine of Rs.200/- was imposed on him. Thereafter, A1 called his father-A2 over phone to the spot. While the 2nd respondent and his superior officers went to nearby sweet shop, both A1 and A2 came there and shouted by saying that they will contest in the Court.
3. Considering the facts and circumstances of the case and the allegations made against the petitioners, this Court is not inclined to interfere with the proceedings in the above C.C.
4. At this stage, the learned Counsel for the petitioners prayed for dispensing with the presence of the petitioners before the trial Court.
5. In view of the above submission, the presence of the petitioners before the trial Court is dispensed with except on the dates when their presence is specifically insisted by the trial Court. The petitioners are directed to be represented through a Counsel before the trial Court on all hearing dates.
6. Accordingly, the Criminal Petition is disposed of. Miscellaneous petitions pending, if any, shall stand closed.
