HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.4587 of 2017 ORDER:

In this petition filed under Sections 437 and 439 Cr.P.C., Petitioners/A1 and A2 seek regular bail in C.O.R.No.151 of 2017, Excise, Mahabubabad District, which was registered for the offence under Section 8 (c) of N.D.P.S.Act, 1985.

The prosecution case is that on reliable information, the P & E S.I. along with staff, Hyderabad proceeded to H.No.6-130/235, Sriram Bhadraiah Colony, Mahabubabad and conducted house search and having found 53 polythene packets (each 2 kgs, total 106 kgs of dry ganja), seized the same and found A.1 and A.3 were in possession of the said contra band in the said house. A.3 who is said to have supplied ganja to A.1 and A.2 absconded. A.1 and A.2 were arrested. It is seen that commercial quantity of contra band is seized from the possession of accused and investigation is in the initial stage. Having regard to these facts, it is not a fit case to grant bail to the petitioners/A1 and A2.

Accordingly, this Criminal Petition is dismissed. As a sequel, miscellaneous applications pending if any, shall stand closed.
